I was backing out of a parking space and someone stopped behind me to talk to a friend. She was pulled up enough so that when I looked over my right shoulder I could not see her. I did not look over my left shoulder because it was a one way and there should not have been anyone there. In backing up I clipped her bumper. Would this be my fault or her fault?

Yup, 100% all day and every day.
You have a duty to make sure the area behind you is clear. There was a breach of that duty. You tried... just not enough. The other person had not opportunity to avoid the accident.
I don't doubt that this was just a mistake on your part and it was not a big mistake but it just happened. |

| (I think?..) If you back up into someone it's AUTOMATICALLY your fault. That same thing happened with me. My friend was parked IN FRONT of me, in a parking lot. We BOTH got into our cars, to go somewhere. She ASSUMED I had already starting backing up, to let her out of the space. She started backing up first. She hit my front bumper. It din't do ALOT of damage...just a noticable dent. I had an older car ( a 1987 Baretta) So, I wasn't REALLY worried about it. She DID turn it in to her insurance company. I don't know why, but, I guess she thought this accident would be MY fault bacause I was at a 'standstill.' Needless to say. her payments went higher, for her policy. YEP...her insurance company said it was HER fault. |
