Who will pay the medical bills?

I had an accident. I was hit by another car. My insurance lapsed and I was in the middle of getting a new one. The next day I did. Who would be responsible for medical and so forth?

Have you tried collecting the insurance info of the other guy? If you are injured in an accident in which you are not at-fault, the other party's liability coverage will pay for your damages.

I was hit by another car.


How?

Taking your word that you were hit, you can collect under the at-fault party's bodily injury coverage for the medical expenses, pain and suffering and loss of wage, provided the other person has his policy in place.

Please help us with some additional details.

Its understandable that you have fallen into a pit, since you were actually without any coverage at the time of accident.

I would rather be surprised if the new policy covers the losses as the accident took place before the coverage begins. But hold on a second, have you had the policy binder in force at the time of accident? Then you may receive coverage under your new policy. You may enquire about it with your agent.

Many states are "No-fault" states (have PIP) and provide tort immunity to a certain degree. If the OP is in one of these states he/she would not be able to collect from the at fault part. No way to answer this question w/o knowing what state the OP is in.

Keep in mind that PIP (personal injury protection) is generally considered a no-fault coverage, but it applies to the insured vehicle, and will not cover injuries to persons in the OTHER vehicle. That would be Bodily Injury liability that would take care of the other party if the insured were at fault. So, if our OP has insurance, has PIP, then it would apply.

We have no idea of what state the OP lives in, whether a binder had indeed been placed prior to the accident, and all the OP stated was that he was "hit by another car" which could mean a whole lot of different things.

So...OP? How about some additional info so that we might be able to help you out?? Like, what state do you live in? Describe the accident? Did you actually secure another insurance policy, and was coverage in effect through a binder issued by an agent?

Please follow up on your original post...we want to help and really need the additional information.

If you are saying your policy lapsed then you got a policy with ANOTHER company AFTER the loss.

If you renewed your laspsed policy with the same company and was within the time period (usually ten days) you may have coverage with your original carrier, but ONLY if you renewed with them.....Unless there is some other information we are not getting from you.....Sorry sounds to me like it's all yours.

Agreed, without any additional information its almost impossible to give him any definite suggestion. Unfortunately, with the scanty info, it obviously sounds like that he is responsible for the expenses.

You are right tcope, if he resides in the no-fault state, he can't receive the compensation from the other party's insurance. But all these are conjectures. Until and unless we get some more info we can't be more specific with our answers.

I hope he will be more elaborate with his next post and will help us to help him in a better way.
