Can I make insurance company declare my car totaled?

I don't think jimmy is trying to commit insurance fraud. I think he's wondering how Gap Insurance works. If they total his car, he wants to know if the gap insurance will pay off the remainder of what he owes on it. I have no idea how the mechanics of such a claim would work, but I think that is exactly what gap insurance is for.

Gap ins. picks up the ''gap'' between the ACV of the vehicle and loan balance, (minus any unrepaired prior damage), some will include the deductible, most do not...

If my car was totaled in a flood and my gap insurance covered the remainder of the payoff, will I also get enough to help me get another vehicle?

NO! you get up to the pay off..most GAP policys also have a limit of say 7k

well what can I say, Im very disappointed...My insurance carrier called me to inform me that my vehicle is total due to severe tornado weather, ugh so sad such a pretty car. Grand Prix GTP supercharger with heated seats and sun roof etc..I cant forget my moon roof etc.. My question is this say my pay out option is 13,ooo something..but the settlement check will be like 15,300....I also have gap insurance I had the car for 2 years paid 400month plus full coverage insurance through state farm...What am I suppose to do??? Never been in this situation

If my car is worth 10,000 dollars,(according to the adjuster), how much is it worth if I get it completely fixed, but, it still has a carfax reporting of flood damage?

It will be worth less after it's been fixed. The 10k is what the actual cash value is now (pre accident).

My wife was involved in a accident two weeks ago. The van that hit her was in the turn lane and tried to get across the highway into another driveway. The driver hit her very hard with damage starting just front of the driver door taking out the sliding door on the driver side and pushing the rear panel back about 1/2 inch. The front corner of the roof at the driver door has shifted down about 1/2 to 1 inch. They want to fix this damage on my wifes Town and Country van. A full size ford van is what hit her. I am not comfortable with the door jam between the driver and the sliding door being cut and weilded into place to fix it. I think that this is not the factory "fix" that is needed. She will not be made whole. I am seeing this fix as being possible problem if she is hit on that side again. It is my belief that injury is more of a outcome the next time she is hit on that side. What can I do to help her to get this straightened out? The van is in her name only, so I don't have much say on this. Please send a reply to tommytuckercbvnol.com What about demished value?

Unless you can get the auto body repair shop to argue the matter in your behalf (which means they will get nothing if your vehicle is totaled), you may have little recourse. Diminished value is a better avenue to pursue.

If you are not comfortable with your wife driving a repaired vehicle, trade it in on a different vehicle, disclosing the prior damage (which will help establish your diminished value claim).

My 09 Lancer was flooded during Irene. By the time I arrived back home, the water in the car had receded to about 6 inches in the car, but the seats were soaked as well as the gearbox. the battery still works and the adjuster wont be out to look at it for days, in which time it will all be dry. Will they total it or just fix it and stick me with a problem waiting to happen?

There should be a water line remaining in the car indicating it was below water and will most likely be totaled. Too many seat belt and air bag diagnostic computer modules may have been compromised and they likely will not want to be liable for them in a subsequent loss where they may not deploy due to exposure from water. Not to mention you will be dealing with mold at some future date very likely.
