my problem

I have a 2004 BMW x3 truck I hit a tree and It wont start. State farm is trying to say that its fixable at 16,100 but the body shop says that its 16,600 and that's not with him breaking it down and seeing if its start-able. Its been a month and state farm hasn't done any thing and my rent a car balance is maxed out. How can state farm declare its fixable if the body shop hasn't even finish with the estimated total of all the work Even the bmw dealership told me that they wouldnt fix this truck.. Help can I fight that it's totaled?

I understand that your adjuster is undervaluing your car.
Why don't you try reducing the cost of repairing using the USED or NON-OEM assuring to ignore any cosmetic damage that would let the insurer do the repairs in accordance with the pre-stated ACV allowance. One thing you'd need to remember is that you ought to convey your demands in writing to the adjuster. Show him your way of arriving at the estimation of the 'fixing'. Your verbiage should indicate the fact that you're demanding & expecting a true & fair compensation from the part of the carrier.

Has it been under repair this whole time? Is it actually being repaired now? When was the estimate written? When did it get under repair? Did it go to one of state farms 'preferred' shops? I looked up your truck but need additional information to figure a value for your (thus see if it should total or not)...is it a 3.oiAWD or 2.5i AWD? then need mileage and ALL options including bmw prem. sterio, funning boards, luggage rack, navigation system, power sun foor, sport package, tow/camper pkg, auto or manual tranny, cruise, leather seats, power seats, ? If you'd answer all of those I'll find a value, also the state that you are in...from what I've looked up so far, I agree they should've totaled it...Call the body shop ask what other damage was found after tear down...what they are anticipating the total cost of repair to be...also when the truck will be done...then we can get you more acurate information....hang in there..
