Maximum time limit of filing a claim ??

Hi friends, a few months back I was involved in a car accident. Do you guys have any idea as to what is the maximum time limit before which one has to file a claim? I am in a fix, please help.

Hey Linda, hope you were not injured. Coming to your query, its certainly helpful to file the claim with the right people as soon as possible. Why I say this is because that would give your insurance co. ample time to deal with the situation and as it happened with me you will also get their full cooperation.

Remember this, claims are generally of two types, (a) One that you file in case someone else is liable, and (b) One that you file under your own policy.

Now, if you were to file a liability claim against the other person's insurer then you better hurry up coz you have just 12 months time from the day of the mishap to file a lawsuit against the one responsible and his/her insurance company. In case you are still undergoing treatment or your claim is still unsettled, please make sure that you ask a representative of your insurance carrier about a time limit. As far as my understanding that also has a one year restriction.

On the contrary, you get a much longer time in which to file a claim with your own insurance company. Your company will be responsible for your policies for as long as 10 yrs.

Thank you people. This conversation has certainly cleared some of my doubts and also I have been cleared of some pre assumptions that turned out to be incorrect.. One thing I would like to know how important it is to see a doctor right away after an accident. I mean does it help in any way while one goes for a claim.

Make sure that you see a doctor as soon as you can. Now, there are important reasons to see a doctor immediately after an accident. Firstly, and most importantly you do that to be sure that you are ok. It might seem to you that you are perfectly fine but once you meet the doctor he tells you that something is wrong. So better prevent than cure. Secondly, having everything (date, time and the cause of the injury) in one place would certainly help you in the future if you come to know that the scale of the injury was more serious than you had actually presumed it to be.

12 months to file a claim...? The amount of time depends on who it's filed with (1st party=your own carrier=under a contract or 3rd party=other persons carrier=liability) and what state the accident happen in. It's regulated by the states Statute of Limitations.

It could be 12 months... it could be 4 years.

Hi! I thinka the faster you fill the claim - the better.But if something's wrong with you and you cannot do this - you will be able to fill the claim before your insurance policy is exceeded.
