If the beneficiary to an estates residue dies...

...after the testaor, & a 2nd beneficiary was named in the will being the 1st beneficiarys children. Then unclaimed property was turned in to the comptrollers office (that wasn't listed in the will)..Who would then be entitled to the unclaimed property? Thanks~ :)

Anyone who thinks they have a claim to it in most states. But most Wills have language that would address what is to happen to property not specifically listed.

See, when the beneficiary is the insured's estate, then his death benefit has to be probated and finally distributed as per his instructions mentioned in his last will. In the absence of a valid will, his legal beneficiaries would be identified by the laws in his state.
