allstate condo homeowner poilcy cover slander/libel?

i am being sued for slander/libel. Can't find my allstate policy they claim condo policies don't cover this particulaR thing.

Is that standard?

Slander and Libel are considered "personal injury" type losses, and homeowner insurance policies will not normally cover personal injury exposures. Other types of personal injury exposures include false imprisonment and defamation of character (not just slander/libel). The liability coverage under your policy will normally only extend to "bodily injury" and "property damage" losses caused by negligence on the part of an insured.



Now, that being said- I've also seen some carriers that WILL cover personal injury losses through an endorsement to the contract. Keep in mind that this would be an exception- the standard HO contract won't typically cover this.



You're on the right track- check your policy. Look in Section II: Personal Liability, and read the entire section thoroughly. Liability contract language is notorious for showing you a glimpse of coverage in one area of the policy and then excluding it later or adding conditions to the coverage.



I gotta hunch that you may be on the hook for this. If you could give us a little more info as to what occurred, we may be able to give you info back that may help you out.

I'd agree with Teacher, personal injuries aren't covered under the standard policies. One may have to purchase the personal injury endorsement to protect themselves against such claims. You need to go through the policy document to ensure what's covered. But I too can't offer you much hope unless you have it inbuilt (some companies do have this coverage inbuilt in their policies) or have luckily added the 'personal injury' coverage to your condo insurance.

bmwdoll, Unfortunately there is likely no coverage...any chance you have another policy that might come into play? Have you received a written denial from allstate?



You don't see libel/slander suits often at all, and see them win even less.....have you actually been served with suit papers? Libel would mean you proclaimed something in writing that was incorrect, AND damaged the person. I believe it further has to be a publication..if you write for a paper, or some such publication, have you told your employer? They most certainly would have a policy that covers this...Slander is the spoken word, and much harder to prove...What exactly is the claim?

Lori, great point. I have seen slander/libel cases within commercial policies, and the tough part isn't the published articles; it's proving the damages. What most don't understand are the negligence aspects, in order for there to be a claim for slander/libel to be paid, there would have to be actual damages of some sort. That's the hard part to prove.

Yeah, the business policies often have coverage against probable lawsuits arising from slander and liable, but its not likely that a homeowner would get sued for such issues. If the OP is a business owner and have got sued for slander, he must seek coverage with his business policy. The condo insurance wouldn't cover the issue if its related to business even if he has the personal injury coverage embedded in it.

although the homeowner policies usually doesnt cover this, i have seen the personal umbrella policy extend coverage. just an fyi
