insurance comp. is not paying for rebulding

Hello,

Can insurance company not pay for rebuild the house after the fire?
House is total. They are saying that during the fayer the owner, my son was not in New York. House was never vacant. Me and my husband also lived in the house. He left on November to Vegas for a new job and he was on a probation for 3-6 month. Fire happened in January. He dos not have a residency in Vegas or any other place. Now insurance company dos not recognize him as a resident of that address. And sans he is not we do not exist. Insurance company agent new that he is living for a new job and by his advise he had to get a Vegas driving liense.

Can they do this?

Tough to read that post and there is a lot of info missing.

I'm guessing that they are denying coverage for the fire as the home was "vacant"? You never really state why they are denying the claim. if so, read the policy to learn what this means. If someone _was_ living in the home then you should be able to prove this, no?

If you were living in the house were you getting mail there? Did you have anything delivered to the home with your name on it? Are you paying any of the bills for the home? What about the neighbors... did they see you living in the home?

He dos not have a residency in Vegas or any other place.


Your son was living in Las Vegas with no residence there? How is that possible?

Has the insurance company sent a written denial at this time? If not, the claim has not been denied. have they send a Reservations of Rights letter?

My son and us had only one residency. The house that we lived in. In Vegas he is living in his cousins house.

Yes he received all his mail at that address. He payed the house taxes and house insurance at that address.

Yes we received a letter from ins. company, they are stating that they will pay for his personal property but not for the dwelling. because at the time of the fire he was not in New York. They do not consider him resident of that address.

Not being a resident of the household is not an exclusion under the policy. Why, exactly, are they excluding coverage? Do you have a denial in writing or a Reservation of Rights letter?

We had Deluxe homeowners policy.

House did and home owners policy is under my sons name. His parents us lived together.
Yes we received letter from them. They are not paying for dwelling because at the time of fire, my son, owner of the house was not in New York. But we lived in that house for over 7 years.
As for us, like we do not exist. His parents. They trow us in the street.

A denial will contain policy language, usually the exclusion that applies. "was not in New York" is not a reason to deny a claim or an exclusion under the policy.

When my son left for Vegas he shipped his car. By the advice of our ins. agent he changed his drivers license to Vegas driving license.

Now because he has a Vegas driving license, Insurance company dos not recognize him as a residents of that address in New York.

And if Ins. comp. dos not recognize him as a resident its mean we do not exist for them.

They are not paying for anything to us. Me and my husband.

PS: Our name is not in ins.policy. But in policy it says that all house hold members are covered. But steal they are not recognizing us. We are practically in the street almost a year.

You've still not addressed any of my questions or added any info. I'll ask again... has the insurance company sent a written denial or a Reservation of Rights letter? If so, what specific reason(s) have they _quoted_ from the policy as a reason for the coverage question or denial. When (if) you answer these questions they someone might be able to help.

Yes we did get a letter from insurance company.

All the reasons I just e-mail it to you, That they are not recognize my son as a residence of New York. Because during a fire he was not in New york and he had a Vegas Driving License.

This is the reason.

If this is the "reason" listed then I'd highly recommend that you file a complaint with the Dept of Ins as this is not an exclusion under the policy. I'm not a resident of NY and millions of other people are not. Our claims are not excluded for this reason.

Does your son own this home that is insured? Are they saying that he does not have an insurable interest in the home?

There are million of people that have two homes and both are insured. Not living in NY is not a reason why their claims would be denied.

I'm sorry to say but I really don't think this is what the denial states. What I _think_ is probably mentioned in is that the policy does not provide coverage for fire when the home is vacant. But if so, I mentioned some info in a prior post that would apply.

The house was never vacant. We all lived in that house.
House was fully insured. Deluxe home owners policy.

Like I told you, in the letter they stated only <AT THE TIME OF THE FIRE HE WAS NOT IN NEW YORK<
