LTD OVERPAYMENT - TRANSITION FROM OWN OCCUPATION TO ANY

After I was approved for SSDI I received a lump sum payment. My LTD provider stated it was due them..sent check to them.

After my children SSDI benefits were approved, they received a lump sum payment. My LTd provider stated another overpayment was generated due to their benefits now..I did not send them the lump sum payment.

Shortly afterwards, the amount of the overpayment they said was due to them was sent to a outside collection agency, after signs that my claim was not going to be approved at the transitioning point from "own occupation to any occupation, I did not make any arrangements with them to repay this over payment.

Today I received a phone stating my benefits were going to continue past the "own occupation" phase, however after they received update notes from my next doctor appointments, I would be getting a phone call from a Vocab Rehab specialist. Question whats happens to the overpayment have they written it off and now I deal with the collection agency?? Will my benefits be reduced?? Am I at the "safe" point in my claim now that I have passed the "any occupation" level?? My policy states my benefits can continue to the age of 65 will all health, dental, and life insurance premiums paid for by them to my former employer.

Well, I don't think it's possible for us to know whether your debt is past the SOL, with the information that you provided to us. When was this over payment generated? Also, please let us know which state you belong to.

I live in Kentucky, the overpayment received by SSA in 10/10. I received a letter from my LTD Provider in 11/10 and within two weeks, I received a letter from an outside collection agency. When this happened I assumed my LTD provider was preparing to deny my claim continuance for "any occupation".
I paid back the original overpayment after receiving my lumpsum from SSA but my children's I do not feel they are entitled to.

It is highly unlikely that your disability policy includes any benefit for your children. Make them show you the provision in your contract which requires any repayment -- of your "lump sum" or your children's.
