I want you all to help me with my disability that I got before my employer terminated my services. The main problem here is that I received an ankle injury before I was laid off. But the doctor who treated me under-diagnosed my health and certified that I was fit to walk and work.
He only suggested that I wear a brace while working. I had to report about my injury to the HR department and showed the doctor’s report that explained I don’t require disability insurance coverage. After that they started downsizing and I was without a job overnight. However, my injury worsened and now I would have to go for another surgery to treat it after almost a year.
I want to know if I can file a claim for disability benefits since the diagnosis wasn't correct and that I received the injury while I was employed. Is it too late to recover? Can I make the claim now? I could never imagine that I would have to undergo multiple surgeries for this injury. What if I qualify for the retroactive disability benefits by showing my employer that I am seeking those benefits much before I was sacked? Luckily, COBRA had me covered during my surgeries, but the problem is I don’t have any steady source of income and my savings too aren’t that much. Even state unemployment benefits seems to be a distant dream for me because I can’t move around.
This leaves me with little option but to stay back at home and so, I won’t be able to go for interviews or to the unemployment office. I am looking forward to social security disability benefits but heard that they are only for long-term chronic health conditions. Please advise.

If this was a work-related injury, you should have been treated under Workers' Compensation laws. It does not appear that this was the case.

Your injury is insufficient to qualify for Social Security Disability. You may be entitled to a limited state disability benefit. Otherwise, if you need income, you must work.
