auto in my name, insurance in someone else's

Can someone legally have insurance on a car that is my name and not in theirs.

Good morning Sunshine375 and welcome...

Well, I've seen many policies that have the owner as the 'insured' but they NEVER drive the blasted car...

I'm not sure what this circumstance of your's is...Are you asking if you do not want this vehicle insured, and you have the vehicle...can another go get insurance on it? Why would anyone want to do that? Or is your name the legal owner, and someone else has the car? Please explain a little more, about the specifics here...

The car is in my name and it's not paid for yet. I want to let my brother use it for a little while but I don't want to put him on my insurance. Can he legally add my vehicle to his existing policy if the car is registered only in my name? I don't want to do anything illegal.

If I'm understanding you correctly you would in effect have two policys on the one car correct? Or would you drop yours? I don't think it would be illegal persay, but would be a waste of money. Your policy would be the one that paid, should there be a loss. You cannot have two auto insurance policys on one vehicle. Now there may be a way you could cancel yours and he write a new one, but I wouldn't advise that, what if it lapsed for some reason? You would still be liable for the note of course, and also the vehicle owner.... you would have notify the lein holder etc.... how long do you anticipate him 'borrowing' your car?

. Does he have a really bad driving record or something? Is that why you don't want to add him as a driver? I think the best way to handle this would be to contact your agent/company and tell them how long he will have use of the vehicle , and have HIM pay any additional premium for the length of time he will be driving it....If he is just going to use it occasionally not for his 'regular' use, then you may not have to do anything....

He doesn't have a stellar driving record by any means! I'm just trying to help him out until he can get back on his feet.

So what you're saying is if I cancel the policy in my name and he adds the insurance to his name, then if something happens, it won't be covered?

No, that's not what I was saying. I said, if he would get a policy WHILE yours was still in force (meaning two policys on car) that yours would still be the one taking car of claims/be primary, the other would (I believe in most states/instances) be void.

I believe you can cancel yours and he get one himself, of course you as the owner of the vehicle. Your lein holder will have to be notified that the insurance has changed.

Again though I would advise and caution you that this is risky business. There is always a chance (no matter how small) that he might let this policy lapse. If that should happen you as the owner would still bare the full responsiblity for your lein of course, and more than likely some responsiblity for any accident that occured as the vehicle owner. The only way I would personally do something like that is if I actually issued payment and he paid me back, thereby knowing 100% that the vehicle is insured at all times.

Also if you chose to do this, make sure prior to canceling your policy that you make sure there is one in force. Frankly this whole thing would worry me.

Again were it me I would keep my policy and add him as an insured driver, and have him pay the entire premium.

This is generally not possible unless you and your brother live together and are dependent on one another, and even then you probably will not find an insurance company willing to do this.

The car is registered in my name but doesn't have insurance on it... it is currently not being used... my brother want to use it for a month... can he get insurance in his name if the car is registered in my name... also if not can i still hold the title (legal ownership of the car) but let him register the car in his name and get insurance.

Your brother can get insurance called "named non-owner" -- it is for people who don't own a vehicle but need to drive. It will cover him while driving any vehicle, including a rental. However, motor vehicle laws may still require YOUR vehicle to be insured if operated on a public street.

Your brother can get insurance on the vehicle himself as he's have an insurable interest in it... as he needs it for transportation. My recommendation is that you are listed as a driver as well. You may want to check on the registration as the DMV may have suspended it.
