I was out on bedrest for 6 weeks prior to the birth of my twins. They were born at the end of October. As agreed with employer, I am not returning until Jan. 2nd (that's 4 months out of work total). However, I have decided that I am not going to return to work (emotional and financial reasons). How will this effect my short term disability I have collected? Will I have to pay it back? My employer pays for this policy as part of my benefits in the state of NC. Thx.

Honey, the insurance is an agreement between you and the insurer. I believe that the policy documents states out that you are the named insured in the policy and entitled to receive such and such benefits. Therefore, if you have satisfied the qualifying criteria you will receive the benefits as well. The employer plays no role in the above scenario.

Well, if you have decided not to return to the work make sure you obtain doctor's suggestions regarding it.

In NC if the employee refuses to return to work after recovery, he/she needs to support his/her claim with strong medical evidences, otherwise the STD benefits will discontinue.

Your disability benefits will be subject to state taxes if you refuse to return to your job after recovery. If the employer is not paying out your benefits then he/she may not submit a new W-4 form, which entitles you of the tax exemptions. Now if you refuse to return to the work, the employer may not submit a new W-4, then the taxes will be levied upon you under normal terms.

Good point burried_in_dark, the key is ''qualifying criteria" I would talk with the benefits coordinator, and/or look over your policy very carefully. If for instance it says you must return and work 30days then rather than have to repay that entire amount that is what I'd do (if that were/is the case)....Best to know that upfront...I totally understand you're wanting to stay home with your babies...and agree ten million percent! However, if working a short time to protect your familys finances (not to have to repay what you've received)...I personally would get thru that time...(again not that i know that's the case, but certainly would check that out!)....please let us know the outcome...congratulations on your 'double blessing'! I am currently on leave from a hysterectomy and was offered a better job with more money. I have short term disabilty through an insurance provider but i pay it directly from my check. I want to return to work but only give my 2 wks notice and then go to my new job. I dont want any hassle from my current employer.

I returned to work today from STD and want to quit. Will I have to repay my STD $$ that I received? I want to give a 1 week notice. The benefits were payed out of my check and I pay a portion to have them.
