a contractor forged my name on a 9000 check also was able to

the contractor never had to get a signature of the mortgagee to cash 2 party check 35000 first check I signed he deposited with out mortgagee signing. A 9000 check i found out was cash once again the contractor forged my signature but didnt get the mortgagee signature do i have any legal recourse

If he's forged your signature, then I guess it's reason enough to sue him at the court of law. Now, how did you come to know of these activities?

I asked him for the check and he didnt give it to me so i called my adjuster who told me it had been cashed

Usually checks are mailed to the insured but I have heard of adjusters mailing them to the repairers. You need to let your insurance company know that you never signed the checks so that they can inform their bank and the bank can perform a fraud investigation. This is a criminal matter. Better to handle as such rather then trying to handle it as a civil matter.
