Fred, I would like to update you my situation with Liberty Mutual. The adjuster initially offered me $12900 and then to $13900 two weeks ago. This past Tuesday, it came up to $14585.48. Last night I emailed two more comps I found online to LM and the figure is upped to $15292. I have to drop the comp from Carmax in order to reason with LM. I also consulted with an attorney this afternoon about my situation. He and I both agreed that hiring an attorney won't be cost effective in dealing with $2000 difference. So I decided to accept the offer of $15292. Though it is $700 short of my expectation, it is really close. I have to say goodbye to that van with 52K at Carmax and try to find another equivalent one should there be any.

Here is the email the adjuster sent me today.

I have reviewed your prior email which I will go with in regards to resolving this claim......I will agree to offer 50% of the difference in what you had stated you would settle for and my value I offered. See below:

$16,000.00 you agreed to settle for
$14585.48 Liberty Mutual's last offer
difference in both offers would be $1415.52 and take 50% = $707.76

I offer the following settlement.... $14585.48 plus $707.76=$15292.24

What does this calculation base on? Not on comps, not on current value. It's like "Let's settle this by dividing the difference in the middle." So what does this say about LM? Do they really know the meaning of indemnity?

Thank you for your opinion. I feel like I have exhausted all the means and yet I have to fight with the insurance company on my own. Though this won't help much in my negotiation with them, I am much confident in asking what I truly deserve. I am still fighting now. I have tried to find more comps online to maintain my ground in negotiation. They will take away the rental tomorrow. I prepare to fight one more week to see if they could up their game a bit more. Thanks again.
