Drama in Real Life

Here's an interesting email I received this morning.
So that everyone can truly appreciate it, I've only eliminated the last names - nothing else was changed.

I was looking at your site and it was verry impressive. I have a problem myself and im so confussed I dont know what to do. Maybe you can help me or lead me to the right direction.
Ok heres my story
My fahter Carlos passed away October 2001.
I never knew he had life insurance untill 2 weeks ago when a ladie at a coffee shop told me that my fathers x girlfreind "Gina" was robbing us from our money. I didnt understand becuase we have no money. This ladie did all the paper work for Gina and since then got into an arguement with her and thats why she is coming out in the open. She explained to me that Gina had told her that she was married to him and that her son was my fathers only kid. So the checks were written under her name. She knew all about me and my other brother and failed to mention our names. She was never married to my father and had already split from him 5 years before his death. My mother was his wife and she was my mothers best friend and was having an affair with my father. She also said she paid for my fathers funeral cost which i have proof that i paid for everything. Is this fraud?
She is also on welfare and so she has put the money into her other kids bank account so that welfare doesnt cut her off. The first two checks were cashed in TD Canada Trust in September and December 2002. I just dont understand why she gets the money when she's not even related to my father in any way. she was with another man at the time.
What should i do?
please help

Did you contact the funeral home (that you say you were in touch with rather than her) & get a lien against his policy?

Hi,

I just don't understand why she gets the money when she's not even related to my father in any way.

Did you hear about the clause that talks of 'insurable interest'?
It once stated that a beneficiary must have an 'insurable interest' upon the insured's life so that he could be named as the 'beneficiary'. But since the repercussions of the gay section came into light, it has been accepted to declare the 'named beneficiary' as per the personal choice of the 'named insured'. So, the most important thing would be to find out whether she was a 'beneficiary' or even for that matter - whether she was the latest 'beneficiary' as per your father's wish.
Please check that one out...& do keep us updated.

hey, beneficiaries could be both primary or secondary. You need to get the whole thing to the notice of the insurance co. talking to the agent won't solve the entire problem. You need to find out whether you or your brother are actually counted as the primary or the secondary beneficiaries at all.

As my experience suggests insurance co. would conduct an investigation & crosscheck with their records to make sure that the checks don't land with the wrong person (since that would cause them more legals hassles in the future). All the best : )

Lot of misspelled words. lol If that is a true story then it is a sure case of fraud and should be reported and investigated by officials.

I think you should meet the concern person. Get all the details, paper work done before & then ask the officials to investigate this case.

Make sure YOU have all of your 'ducks in a row' before you talk to someone about it.
