"Is there a Federal or Texas Law that states a time deadline to file a Health Insurance Claim? If so, what is that time?"

Last year our Ancillary Accident carrier said we did not contact them wiithin 90 days of the Soccer Injury Accident (was about 122 days); therefore, they are not paying any claims (about $5000).

I thought as long as you have a policy & file in that year it didn't matter. Am I wrong - in Texas?

Well, you are required to file with the insurer at your earliest. Insurance is regulated by the state laws. Therefore, you may check with the statute of limitation of Texas. And in absence of state guideline the companies would follow their internal guideline on this issue. Have you read the policy document carefully? It should have described the time limit regarding filing claim.

However, I'm not sure if there is Federal laws to govern this issue but would definitely search for more information.

Have you served the insurer the 'notice of claim' on time? The notice of claim from the insured's side is required as to make the insurer respond urgently to the losses. Delay in submitting the notice of claim would lead the insurer to deny the claim.

IF you did not notify the insurer of the claim within 90 days, they are more than likely going to be allowed to continue to deny the claim.

well. the one thing can help you to claim this is you did not relazie that you are supposed to claim within 90days. so the judge will re count another 90days period from the day you know this limitted period. but you should to provide the proof to convince all person that you only realize this currently. do they state this limitation on your paper already or you can't read it?

Correct me if i am wrong, but to my understanding any kind of insurance policy would have a notice period that might differ but generally 90days, for a claim to be filed.

But i really wonder if an argument saying
