Ok today I received an email asking me and I quote "I should have my review completed by tomorrow 7/16/08. I will look it over and contact you with our position on Thursday or Friday. In the interim, what are the breakdown of your medical expenses and what you calculate to be your wage loss?"
Ok. Now, I know I am nitpicking, but I read "our position" and sort of get a bad feeling. Meaning does he mean may be not covered?
BUT, then I wonder why he would ak me what my medical and lost wages are if they were not going to cover me? What would the point be?
If it is considered a "reaggravation" of a pre existing injury is it the pain and suffering that is lower? Or the wages/medical as well?

No, most of the time the pain and suffering would be all that is lowered assuming you had not been treating for the prior injury right up to the time or near the time of the new injury...by position she probably means if they are looking at it as pre-exisiting and also may just be using that term for the 'range' they put on the injury. _________________ **************************************

Thank you Lori. I had not missed even 1 day of work since my last injury. That is a plus obviously right?
I can deal with the pain and suffering being lower I just don't want to get screwed on my out of pocket.

Ok last question then. If their first offer is near the bottom but it is an amount I would be happy with should I take it? Or if I go back with another number will it take a lot longer and/or have them change their mind on offering anything?

Depends on how high your counter is...If you want to take the first offer then go right ahead....If you were my son/brother/ I'd tell you why don't you come back here and post, after they make their first offer, tell them you really thought it should be a little more, and you want to think about it....and you'll call them back in a day or so...  _________________ **************************************

STEVE, Sorry that you fell. I also had a slip and fall accident but in my case it was at a grocery store in Florida. I have an attorney and during interogoratories I had to give the store sttorney a list of any accident , injuries and doctors I had seen over the past 10 years. LOL try to remember that far back and thank goodness I had never been injuried (EVER) and only had like 4 other doctor visits that had nother remotely to do with my injured body parts. When we went to Depositions, their attorney only asked for clarification as to what the doctors were for. ex: Dr So & So was for removal of a mole, Dr So So & So was seen for a heel spur. LOL I think their attorney was some what disappointed because I never had any falls, no emergency visits, no broken bones etc. I wish I could describe the look on their attorney's face when she walked in to the Depo and her I was with a back brace and my arm in a cast from arm pit to fingers. She looked at me with hugh round eyes and said OH I see we have a new development. My attorney said Yes I guess we do. LOL
After my depo the store attorney told us the the store KNOWS they have a major problem with my case and they want it settled NOW. We go to settlement meeting in 6 to 8 weeks. I hope you have or get a good attorney. I would have been lost without mine. My attorney has already said that if the store does not want to settle with me he is ready to go right to court. I guess this means I have a very good case. I am now the ower of 3 bulging disks in my back, the back injury is causing my kknees to hurt going up and down stairs (we have stairs goinng up into house house. Dr says the knees hurt because I am trying to compensate to keep my back from hurting more. I have had surgery on my arm from a compressed nerve when I stuck my hand down to catch myself from hitting my head. I still have a numb hand and the dr does not know if it will get better. My stay numb. I am a total mess LOL. I have missed a grand total of 128 days from work and can now only work part time because of the sciatica. I do hope your injury heals better than mine and I strongly suggest you get a good attorney. |

This is an old thread, but one thing needs corrected:

The MIB does not maintain health records. No details can be found in MIB records. An insurance company will only learn about generalities from the MIB. |
