After living in an apt. for 9 months due to a fire in our house, we were led to believe by our adjuster that we had to move back in to our house because the insurance company would not pay any more rent. Our coverage includes "loss of use" for up to $78,000. The rent was $3600/month x 9 = $32,400. We moved back in to a house that was not finished being rebuilt and as a result we were exposed to many adverse conditions (sawdust etc) as well as the emotional and relationship problems that came along with it. I recently saw a case where an actor was led to believe he had tickets to the Oscars but when he got there he was detained for 6 hours and is now sueing the Oscars for $50 million. Do We have a case? And if so who can we get to handle it?

How much did this actor collect? Everyone has a "case". If you can serve someone, you can sue them.

very cryptic reply. The actor case hit the news a few days ago so I don't know if he will get anything. So I gather by your answer that we either don't have a case that will stand up in court or what?

I'm not a judge and I certainly don't know all of the facts. Without knowing all of the facts and being the judge or all jury members, there is no way to know how a case would turn out. Now if you asking if you _can_ file... that is why I said yes. As anyone can file a lawsuit. Hence, the actor you mentioned.

You will need to prove your loss.

If you did not think you could live in the home I would have spoken to a supervisor and pressed the matter at the time.

That's the point. The insurance co. said we had to go thru our adjuster, so "at the time," which we did manage to convince our adjuster to push off twice (ie 2 months) we felt we had no choice. In other words, they wanted us back in in 7 months and we got 9 out of them.

It's very important that we go through our policy papers while signing up. If we don't, we'd rest in peace without actually being aware of our risks. Likewise, we'd often believe that insurance is meant to help us repair our damages and get us where we were at the beginning. It's not true. Insurance simply helps us regain whatever we had prior to our loss.
