I fell off of my sisters deck and broke my ankle in three places. The deck was wet and towels were near the steps where I was trying to hurry because my nephew was going into there swimming pool without a life jacket. Something towel or hose I tripped on and fell forward. Her homeowners will not settle because they feel I wasn't watching where I was walking.

No, they feel that your sister was not negligent in causing you to fall and injure yourself. Saying that you were not watching where you were going, is an opinion. Their descion is not based an opinion.

Well that's kind of true, you aren't even sure of what you tripped over...but KNOW that towels, water, hose etc were there......they do owe you her med pay, regardless of negligence (we don't have ALL the facts so we don't know if your sister was negligent or not). Perhaps, they've already paid out her med pay limit.

How was your sister negligent? In your opinion was did your sister do (or not do) that CAUSED your injury? In order for them to pay your sister would HAVE to have been neglient...(gotta ask...you're going after your sister? really?)
