my neighbour,s tree fell on my cars as they were parked on our driveway .,what to do?

Call both their homeowners ins company and your auto carriers and turn in the claims...It will depend on why the tree fell, but best to get the ball rolling in both courts...you can always withdraw your comprehensive claims on your vehicles if needed..

oh crap I almost forgot DO NOT TOUCH THAT TREE untill you take atleast 36 pictures of it from all angles..

Wow thats a lot of pics! I can imagine it would be ebst to have as many as you possibly can in this matter. How will they determine who is to pay in a case like this? I was thinking if the tree had structural problems like rotting before hand that it would be the tree owners insurance that pays but if it was just mother nature reminding everyone she was there then it would be the home owners insurance that would pay?

yeah fire that's pretty close, if the owner knew or should've know his tree was a hazard to anyone, and could fail (dead for example) then he will likely be on the hook...if a windstorm came threw and knocked it down, then doubtful, i mean what could he have done...incidently the wind has been whippin' up here past several days, so i could sure see this...

No kidding the winds must be moving this way cause wow they are bad today. I live in the woods now and get scared of one falling on my house!...I think as a home owner if I was wanting to protect myself and I had trees that were near someones house I would try to keep an eye on there overall health..just to cover my butt...Sometimes I am glad no one lives near me...

Firey, you have got it quite right, that if the tree was rotten/dying and the condition of it was known to the tree owner then it should be his insurance company who will cover the claim. However, if that's not the situation then I guess the only option that OP has is turning the claim to his auto insurance provider under the comprehensive coverage (yeah! Comprehensive and not Collision).
I was wanting to protect myself and I had trees that were near someones house I would try to keep an eye on there overall health..just to cover my butt.
