Re-applying for my P/C license w/bad record, any advice?

by luckyman » Wed Apr 09, 2008 12:50 am

Hi. I am trying to reapply for my P/C license, but have a criminal history. DOI wants a letter when I go for testing. I want to be truthful about my past, but don't want to blow it and be denied. Do you have any advice or experience with this matter? Hopefully you can answer or at least direct me to some place I can find some answers.

Wants a "letter"? As far as I know, the state should perform a criminal history check on their own. Are you saying they want a letter explaining the charges on your record?

Ouch, California.

I really don't know what they consider in a letter. I'm guessing it's mainly an account of what happen since they don't have access to that information, only the formal charge. I'm not really sure if it can be sugar coated very much. I'd not get into the "crime" very much. Probably want to point out what it was for, that restitution, etc has been made in order to make the situation "right", etc.

Thanks tcope, it seems not very many people have had to deal with this issue and its beginning to make me nerveous. At the same time I wonder if I'm asking this question in the right forum. I really like hanging out here, but am seriously seeking sound advise, maybe I should look elsewhere. You can pm me if you have any ideas.

hey a bit late but I had a felony assault charge back when I was 20 and the case was reduced to a misdemeanor and later on expunged from my records and I know for a fact it is sealed from private background checks but gov can still see it. This was enough to deny me of the life and health license when I am 25. So your chances don't look good unless its a juvy record or more than 10 years ago.

Hi anonymous1

Yes, I am afraid most of the insurers will not like to work with you. However, if you do your research well, you might find insurance companies wanting to insure you for a price much higher than what is normally charged. If you are willing to buy such an insurance, you might find one - you never know.

OK, let's give the poster some additional info here.

Federal law (USC 18 section 1033) states that a person who is convicted of any felony or a misdemeanor involving "breach of trust" must have the authority of the "regulatory official" in your state to get or maintain an insurance license.

In other words, the "letter" that you are referring to is the authority from your insurance commissioner to get your license. You will more than likely have to fill out what's called a "supplementary application" in addition to the regular application when you apply for your license. The supplementary application is somewhat onerous, but certainly not impossible.

The commissioner will review the information and decide whether to issue or not based on the evidence at hand:
** The seriousness of the crime;
** evidence of rehabilitation
** letters of recommendation

and a boatload of other stuff.

So, it's NOT impossible to get your license, it's just going to take a little more on your end- depending on the crime(s) involved.

Good luck with this.
