can an annuity payment be attached in Florida due to a deficiency judgment. annuity from Rhode Island death of Mom

my Mom died in Rhode Island and left several annunity which would be better hanging on to and taking payments. can a judgement for deficiency be attached. Should I take the lump sum or is that more attachable. I'm in Florida

You asked the same question in a different thread. The answer is no matter how you choose to receive payments or take a lump sum, only when the money is in your possession is it subject to the claims of the beneficiary's creditors. Proceeds are not subject to the claims of the decedent's creditors. Those claims must be presented for payment by the estate, if any exists.
