Unfortunately, most likely, BUT if you want to contest his state of mind, you need to contact the insurance carrier immediately! If he changed it over 3 years ago, you might have a big hill to climb, trying to get this over turned...But again, you don't know if you don't try...

A will doesn't counteract the life insurance policy. You could try to fight it, but you would have to prove that your dad was not competent to make his own decisions. That may be hard to do if no one was taking care of him. I mean, if he could pay his own bills and speak his mind, if he knew what day it was and where he lived, chances are he was in the right mind to make changes to his policy if he so desired.

You can have ONE set of names (family members, etc.) to take care of property, etc. Howevr...you can have SOMEONE else, whose name is NOT in the Will, as your Beneficiary, on your Life Insurance. Maybe someone can help me with THIS question: I've heard people talk about 'Living' Wills. Aren't a 'Living'Will and a 'regular' Will (lack of a better word) the same thing?!

A living will is what will protect you if you are ever on life support. The living will lists your wishes instead of leaving the decision to the doctors or family members to take you off life support (or ever put you on it to begin with).

The Last Will and Testament is what will be used to distribute your property or provide for your children after your death.
