My father who has never been in my life took out a life insurance policy on me and my daughter! I know this because the insurance company accidentally sent the papers to my house! With him listed as the benificiary. I am so upset! Not once in my life has he provided a dime to raise me how can he now think he has any right to benefit from mine or my daughters death? This is not right! What can I do to put a stop to this? I do not feel safe at all.

Your father has insurable interest in your life, whether you like it or not. If the insurance company wants to extend that to his granddaughter, that's their prerogative.

Why not? Is your father a serial killer? If it's any consolation, he will not be able to collect the death benefit if he murders you or your daughter. Every state has some form of "slayer" law on their books.

He was in jail for murder for 15 years he came out benifited from grandfathers death then a year later my grandmother became ill there was a problem with the insurance company wanting to pay him for my grandmothers death so he has been fighting the insurance company for payout more than a year already. I have not had contact with him for more then 20 years I am 31. For him to have a policy on me and my daughter makes me very uneasy.

I can see why you may have reason to be concerned. If he murders you or your daughter, he will not be able to collect the benefit. I realize that gives you no comfort, but there is still nothing you can do about it

Unless he is suspected of being involved in her death, I don't know why an insurance company would be fighting payment of a death claim.

I would not assume that you can do nothing about this. It's too important to take that attitude. When he took out the policy, did he have parental rights? I bet that a good local attorney could find a way to get him to drop the policy.

At the very least, I would put him on notice of your fears and let him know that both the police and the insurance company have been notified so that if you do die, they will be looking at him.

Hi everyone... I have a similar question.

Please don't think I'm insensitive about the subject because I'm not. I've cried over it all that I can cry, and now there are other things to be dealt with.

My mother recently passed after a long illness. I know for a fact she had life insurance -- at least one policy -- because she always extolled its virtues, and "made" me purchase a policy at a young age as well.

I'm 99.9% certain that I'm one of the beneficiaries, probably the "main" one as I'm an only child. However, I do not have specific info on the polic(ies), nor access to her will. She lived hours and hours away from me, so I can't "dig" for paperwork. Her husband, whom I don't know very well (they married later in life), will tell me nothing other than "everything is taken care of." That wasn't in regards to insurance specifically, was just about everything right before she passed: cremation, etc. But by "everything," I came later to find that wasn't all-inclusive at all, so I think he's dropping the ball on this too.

It's been a bit now, and he has plans to relocate ASAP, and has still mentioned nothing about insurance. Another family member mentioned something about HIM getting a payout, which I took with a grain of salt. But I simply cannot imagine her changing him to the sole beneficiary. Once he moves, I will very likely never see nor hear from him again. As her adult child who lives hours away, I've only met him a few times, and we honestly have no real reason to stay in touch.

Even if I'm not on the polic(ies), it would be nice to know that for certain, so that I wasn't wondering. I know that she paid the premiums her entire life, and THIS is the reason for paying them... you know?

Assuming she had a will in effect (I can't get straight answers from him), would that will start the ball rolling on insurance? And if so, will the insurance company contact me, assuming she kept my info up to date? I just don't know what to do here, and I feel as though I cannot ask her husband without being tacky.

If it helps, I think one policy is with Mutual of Omaha. Not sure about other(s) though.

PostPosted: Tue May 07, 2013 10:50 pm   Post subject: Help - Surprise ltr from Insur Co re Dads death years ago

Hi- I need some advice. To my amazement I chkd my mail today and found a envelope from an insurance company called AGLA - I opened to learn that they have matched my SS # with my deceased father's supposed life insur policy stating that I am as the son the beneficiary of his life insurance as they have never recvd notice of his death in 2006. I am in somewhat disbelief as I thought first this was some sort of scam - but went online tonight and saw their website - seems legit. Do I call them ? they have enclosed all these forms and I do not feel comfortable filling out ss numbers etc and sending back. they want an cert death certificate from NY and not sure of his exact day of death in Jan a few years ago. PLEASE ADVISE - this would be a true godsend from someplace if this has any relevance or truth to it all! I always wondered how my Dad could have not have had life insur for his kid - maybe I will find out! Thanks

This is probably 100% legitimate. In the aftermath of multistate settlements with much larger insurance companies over notifying beneficiaries that they have not been paid the death benefits they are owed, all insurers have been put on notice that they must take a proactive role in locating and paying beneficiaries.

You are owed the full death benefit PLUS interest from the date of your father's death, less any policy debt that may have existed on the date of death. File the paperwork and collect your money!

Oops! The state already has it. You can file a claim with the State Controller. Proof of identity is required and if multiple persons are associated with the claim, all must file for their share. Visit the website here for more information: http://www.sco.ca.gov/upd.html

PostPosted: Thu Jan 16, 2014 11:11 am   Post subject: 5000 dollar life insurance with first card

My mother had listed a life insurance policy with her first card credit card for $5,000.

when I handled her estate, I sent them a claim form and the required information. They sent me a letter stating that my mothers account was delinquent at the time of her death. My sister was living with her and she had taken all of her paper work including her credit card statements, the only ones I could gather were the ones indicating payments were late no actual monthly statement showing charges and payments. My sister passed away in 2010. In her belongings I found the statements showing her account was current up to October 1997 she passed away October 16, 1997. I have proof now that they provided a denial of my claim based on her account being past due. She was due for her November payment. I realize a lot of time has passed but she worked really hard to keep her policies paid and she had several which were paid with no problem. I believe she also had insurance with the First card to pay any outstanding balance owed. Bottom line, is there any thing I can do to correct this error? I have the letter they originally sent me. the statements from them showing her account was current at the time of her death? I would greatly appreciate any help you can provide.

Your post does not clearly indicate if this was truly life insurance or something a little different known as credit life insurance. The outcome, however, is very different. Genuine life insurance premiums are not usually paid by credit card, but credit life insurance premiums are usually charged to the credit account based on the unpaid balance.

Life insurance associated with credit cards is usually something intended to pay off the unpaid balance on the account. As such, the credit card company is the beneficiary, not anyone else.

If a person dies with an outstanding balance, and the insurance does not pay it off, one of two things happens, the estate receives a bill from the credit card company and eventually pays the claim, or the unpaid balance goes to the grave with the decedent.

If the estate, in your mother's case, paid the card balance and it should have been paid by the insurance company, then you may have a case to be made. If the debt was left to rot because no one paid the bill, then no harm has occurred, because the statute of limitations to collect on the debt has long since run out.

Please contact me using the email link below to discuss your matter confidentially. If your mother's estate is owed money, then it may be possible to recover it, regardless of the amount of time which has passed.
