my mom passed away problem is we listed brother we haven't seen or heard from in over 25 years i have contacted social security no info on a current address there no info period need to find him or declare him dead for insuranc papers any ideas is a lawyer needed

My mother had a similar situation, the mother in law passed away, they had to run an ad in the newspaper asking all heirs to the estate to come forward, also anyone who had claims to the estate. I am not sure what the terminology is for this. I don't know if it is different by state. If you don't get your answer here, there is a site called lawguru(dot)com that may be able to help you. You get one free question there from an attorney. Hope this helps, hope you get an answer soon.

Have you started by asking the insurance company what to do? They may have a specific process for you to follow. That may or may not involve an attorney. If the insurance company isn't helpful than you likely need legal help.

Sorry to hear about your mother passing. I would definitely contact an attorney. If nothing else for the simple fact that the lawyer would probably be informed on the subject or possibly even have dealt with the situation previously.

Goodnatured has made a very good point . Advertisement of the newspaper can help in locating your brother.

Twenty five years is quite a long time and IMO there is a certain time frame after a person can legally be declared dead. However, you can ask your mother's attorney or financial ad visor to take the initiative to find him out.

Yeah, 25 years is quite a long time. That can be very hard for you. You can try what they are suggesting on posting an ad on newspapers. Maybe that can help. Try to ask your attorney on what other things that you can do. In legal matters, your attorney is the best person to talk to.

Hi yeah...these are surely some of the most difficult patches in everyone's life...& all I may tell you is that if the policy could be located but not the beneficiary then I believe the insurance co. would also make some efforts from their side to see if the money could be conveyed to the beneficiary before it gets passed on to the state. I believe they would go through their records to make sure that they have sought all information regarding him. If still nothing surfaces, then I'm sure they are gonna term it under 'unclaimed property'. But from your end, did you try contacting his last employer to know about his whereabouts? Now by going through the address book or phone book of the lost person you might come across a specific contact person who could a real pointer under such circumstances.
