A home owner received an acv check for damage to her roof and siding. She had a replacement cost policy, the roof was replaced but since the siding had only miner damage, she planned to keep the acv money for the siding. When she filed for the depreciation for the roof, the insurer reduced the amount of the depreciation for the roof by the amount of the acv for the siding. Is this legal? Can a homeowner lose their acv money for items they elect not to repair?

I am a contractor and have worked with many insurance companies. While every insurance company is different, it is illegal to keep money from a claim and not get the work done that they gave you the money for. They will expect something from you showing the work was done if that is the policy to do that. They can come back at you for the money you kept and court costs if necessary. On top of that they will drop you and it will be hard if not impossible to get home I surface after that. Just get the work done. The money isn't for your to spend it's to fix your house and insurance company would not have given it to you unless they deemed it necessary. Later on down the road when the damage gets worse it will cost you way more money and you won't be able to file a claim for the same damage.

So I got paid to replace my roof 7 years ago from a hail storm. But never replaced it and used the money to pay my late mortgage payments. Now 2018 another hail/ tornado has hit my house and definitely need a new roof now. Even if I had a new roof put on after the first storm it would still have been damaged in the second Storm. So will I be in trouble if I try another claim?

It is always insured for replacement cost. The cost it will be to rebuild that house. Not what you paid for it.

The insurance will more than likely not pay for your roof since it was not replaced 7 years ago. It will show up on the history. We can see all companies you have been with and we can see all claims with every company you've had. In my office claims go back well beyond a decade and we can see if it got replaced or not. Plus they do inspections after work gets complete. We just had one client try that. The did not get the roof replaced 6 years prior and now the interior walls/ ceiling are damaged from this last storm (Water damage from roof leaking). Their new claim is denied. This was a $500,000 home 3950 square feet in a nice upstanding neighborhood. They thought they would sit on the money ($46,000) and collect interest. She tried to tell us that $2000 was what she got. Uhm.... Bank deposits and bank confirmed cashed check.



Same for cars. You come to us and tell us you have had car insurance and I look at the screen. It tells me you had not had insurance in 6 months. Your rate goes up because you are basically considered irresponsible and typically are a claim waiting to happen (Statistical Average). Most times we turn you down for car insurance if that is the case. It will also tell us if you got the car fixed and when.

In the process of waiting for the check I got sick from mold and my insurance company sent me a paper stating they do not cover mold remediation. I then got the check and had to relocate due to extra repairs some related to storm damage and some not related to storm damage to the tune of 10,000.00 out of my own pocket. I cancelled my insurance policy today because I had to use the insurance money to relocate my family to a safe environment. My agent was not really nice and I was completely honest with her. Any thoughts on this?
