Can I claim swimming pool damage?

The swimming pool in my back yard developed a large crack on its side after my neighbors started doing some drilling work over at their property. I called my insurance company to file a claim as I thought my pool was covered under our homeowner’s policy. They told me it isn’t and that I’d need to purchase a special rider to cover the pool. Can I claim it against my neighbors insurance company? How do I prove that it was the construction work in my neighbor’s yard that damaged my pool?

Yes, you can file the claim against your neighbor’s insurance company. There is a chance they might deny the claim citing the absence of direct damage and evidence to show that it was the construction work which damaged the pool. In such a case, it is consequential damage. You would need a construction or building expert to certify that the damage was caused by the drilling on your neighbor’s property. You might want to consult an independent adjuster as well.

My neighbors pool fell on my above ground pool. It is only 2 years old. It is totally not fixable the pool guys said it needs to be replaced. Will my neighbors home owners insurance pay for it if I file a claim?

Our pool cover and vinyl liner are ruined due to the snowstorm 2015 in MA. Will our homeowners insurance cover?

How much is your deductible? To the extent that your loss exceeds the deductible, you can make a claim for that amount.

Example 1:
Cost of pool cover + liner = $550,00
Deductible = $500.00
Claim payable by Insurance Company = $50.00

Example 2:
Cost of pool cover + liner = $750,00
Deductible = $1,000.00
Claim payable by Insurance Company = $0.00

As for going after your neighbors I would recommend speaking with an attorney in the state you live in as that is more of a liability issue.
As for your own insurance, I would take a close look at your policy as most would have some coverage for pools. If you are not familiar with reading policies I would recommend that you consult with a local public adjuster, attorney or even your agent to see if they could review your policy and show you why the pool would not be covered.
We recently assisted a policyholder with a claim due to tree roots lifting his pool deck several inches and in his policy the pool was actually covered under his Dwelling coverage.

Considering that the original post is now three years old, this matter was either resolved or not. The OP is unlikely to ever return here.

you can file a liability claim for causing the damage to someone else's pool. Your policy would issue payment only of you were negligent in some way. Otherwise if would defend you against the other person's claim.
