Recoverable Depreciation/roofer up charging after insurance

My roofer who I have previously been happy with for a previous major repair (good work/reasonable price) is now telling me something I find wrong in relation to recoverable depreciation but I am not an expert and I certainly am not trying to commit fraud. I'm located in Texas

Scenario is like this:

Roofer quotes $6,300 for an upgraded shingle (from 25 yr to 50yr), then sees insurance replacement cost value $6,500 and is now quoting $6,500 for basic shingles and and additional $1k for the 50yr shingle ($7,500 total) for the same roof that he was quoting $6,300. He is stating that not charging the additional $1k for the upgrade constitutes fraud. BTW - I'm in no way getting or trying to recover my deductible via a fake invoice, ect. The roofer would be pocketing the difference :-(

My understanding of recoverable depreciation is that its sort of a use it or lose it. If I spent $6k to replace the roof then they would only remembers the $6k difference but if I spend $6,500 and happen to get a better material they would still pay out the $6,500 or would they subtract for the better material or constitute this as some sort of fraud?!
