To all
After haggling with the adjuster the final offer was 19,275. At this point I'm burnt out and rather than drag this on for ever, I accepted the offer. I will seek additional out pocket expenses ($432 in cost that they have refused to cover) thru small claims court. What have I got to lose! I will find a new insurance provider for (3) vehicles.
In talking to a car salesman and telling him what I was going thru. He told me he was in the process of buying a new vehicle and was considering Commerce, but not any more.
So as you can tell, word of mouth advertising will cause them to lose more than they saved. I've also heard some very negative comments from people who use to work for the company.
They dragged my situation on for to long, costing them addition rental fees, storage fees, etc.. They probably saved a few bucks in the short term but they will pay more, in the long run.
Nobody benefits from this.
So I would just like to say Thanks to those who contributed to this affair. I hope that you never have to go thru what I went thru.
PS
I did buy another vehicle, and now I have to deal with a used vehicle and the problem of what is wrong with it!

i had a no fault of mine accident, .the bbv. was 9.500.00, the adjuster s had an 8.469.29 damage.i believe this should have been a total loss. iI wasnt offerd any option, they told garage it was not a total loss, fix it. after the work was done,I asked for the company to send an adjuster to make sure all was taken care of. they told me that is only ramdom! my claim policy reads that I have to be available for them to check the work done. they are suppose check the vehicle before it leaves the shop, because there is a release of work completed up to there satisfaction. they did not do any of this. when I called commerce to tell them I wanted someone to look at my car, that there were things wrong, they said go see the the shop who did it and He would determin if it needs more repair. how can they release the car signing a form saying all work was done, if they didn't check it? iI made myself available, at there convience but they again said inspections were random! where do they draw the line of value for it to be considered totaled? please help _________________ Register Now to have your Insurance queries solved. |

If you have a problem with the repairs, the place to begin is the repair shop. That facility is licensed by the state and subject to a variety of laws concerning its workmanship. In California, the agency is the Dept of Consumer Affairs. In your state it may be a similar or different agency. There will be a sign posted in the repair shop telling you to whom you may complain.
If the insurance company sent you to this specific repair shop, then you may ALSO file a complaint with your state's Dept of Insurance in order to obtain their assistance with your claim situation.

You can always call the insurance company's claims department and demand to speak to a higher level supervisor about your situation.
Most states' laws PERMIT the insurance company to total the loss on a vehicle when the damage is more than 75% to 80% of the vehicle's value. No state laws REQUIRE an insurer to do so. If the insurance company wants to spend $10,000 on the repairs for a car valued at $2,000, there is nothing (other than good, old-fashioned common sense) to prevent them from doing so.
