Can company drop daughter from health insurance?

My employer has hired an audit firm which is requiring I provide certain items to continue health coverage for my daughter. My daughter lives with her mom. They are requiring either 1. She is on my tax return. or 2. The divorce papers clearly define continued health coverage by me. This is in addition to her birth certificate. I do not have her on my tax return since she lives with her mom and there is nothing in my divorce papers either - I have just always covered her through my employer. Can they legally drop her?

Most likely....is there a health reason stopping her from buying a separate policy or being covered under her mom?

Did you have a word with your employer regarding this? Go through your policy papers and check what's mentioned about the coverage of your daughter.

You were not ordered to maintain health coverage under the 'child support' section of your divorce decree? Surely that was addressed somewhere in the divorce..

Nothing in divorce papers that says continue her health coverage - only a break down of my co-pay in the child support. I could cover her seperately on my own - but very annoyed when the company WILL cover same sex couples and their adopted children - but not my blood daughter. Don't see why the birth certificate is not enough. Local HR is no help and the audit company has someone answering the phone that is no help - can only say that I should explain circumstances in seperate letter (and basically hope for the best).

Well I guess, the best you can do, is show that you were divorced, 'x' years ago, and it was agreed (between you and wife) that you would provide health coverage for your child. That your ex wife will take you back to court for this should you stop it now. Anyway you could contact the attorney you had in the divorce and have him type up a quick letter that says this was agreed to by both parties?

Do you have custody of her? If your ex-wife has custody, that could be the reason.

Lori is quite right at saying that you should now be looking for the attorney.

I could see only one reason why they'd do it. It seems pretty clear that they're looking for a proof, that you're indeed bearing the cost of her insurance.
