I was coming from my mother's house and it was raining I,I went to step down on the steps and a piece of cement broke off and I fell down about 5 more steps.I went to the hospital in the ambulance, but I was later released.Do you think that I have a good case? The landlord knew about the steps and he still haven't fixed them.

maybe if you can prove this prior knowledge, and you haven't had other slip and falls, or injury claims that are similar...also will depend on how often you walked these steps..most certainly med pay will apply since no negligence needs to exsist, only that the incident occured on the property.

This would be a personal choice.

I'd still doubt this prior knowledge that you're pointing at. How would the landlord know about such a possibility unless something similar would have happened at the staircase?

I agree, it is a personal choice. Myself I would always see what I can do prior to getting an attorney. You can always get one down the road.

One question

If the landlord knew about the steps prior to your accident...did you know?

How did you find out the landlord knew? These are things to be considered. Are you talking about after your accident or is it prior to your falling down?
