Trial lawyers are lobbying for legislation that would make it easier for some Connecticut consumers to sue insurers for unfair claim practices — and potentially collect bigger damages.

Quite often I've seen similar questions in the board “can I sue my insurer?” “can I sue the insurer of the responsible driver?”

Till date it wasn't a very viable option but the new legislation if get passed would definitely make the insurance companies more responsible towards the claims. But at the same time a check should be imposed on the misuse of this power.

Rupert it has always been a viable option to sue ones own carrier (in all states) for unfair claims practices...all states don't recognize third party bad faith...not sure what this legislature will do to make it 'easier' ...also far as I know or have seen any 'won' bad faith claim is huge...punitive damages are allowed in same...as well as compensatory and actual damage.

Well, I think that the claimant can still sue the responsible driver for the damages, which IMO is right since he/she is the person who has caused it. I fail to see the reason to sue the insurer for this issue.

However, I agree that its often difficult for the claimant to establish the pattern in the insurer's denial and also the lawsuit often doesn't worth it, but if instead of passing a law we can make an arrangement with the authority which would react fast to the consumers' claims, it would make things easier for many.

I agree life insurance is very imoprtant for your family. you're definately right about seeing it as additional expense because that's kind of how I see it now because I have a lot of other things to pay off before considering buying life insurance. Thanks for the advice:D
