At the time of the accident there were no witnesses. That was on 10/14. I called to inquire about the claim on Monday and now they say they have one. I have no idea where the witness came from or what they are saying. He/she is not listed on the pd report. I guess at this moment I will have to wait and see, and they are making me wait. I assumed by me having a no turn on red sign and the other person failing to yield when turning left they would have some fault. But I guess not. Thanks for your time.

There is really no way for me to tell you who's at fault with the limited information you provided. But, generally speaking, if you collided with another car (instead of the other car colliding with you), you are probably at fault. As a driver, you are supposed to be aware of your surroundings and exercise care in turning to avoid other vehicles.

There is also a rule of negligence called the "last clear chance" rule. This rule says that if you fail to use the last possible opportunity to avoid a loss, you will be held responsible for the damages done to others.

What have any witnesses said about the collision? I'm sure your perception of the collision is different from that of the other driver. Independent eyewitness accounts could tell you more than I am able to.
