I'm in Illinois. It is a state thing not my insurance. Spoke to legal rep. today. He clarified that UIM only kicks in if you have more than the 3rd party's limits. My policy just sent papers for med release and income verification today.

okay, been busy with work, kids and physical therapy. Spoke to the party at fault's insurance regarding the PD claim. She said they do not cover DV claims. I said okay I will file a small claims suit against the insured - no problem I said. Instantly they would consider a claim if I could provide clear proof. I already sent 2 trade in estimates one from carmax and one from lincoln. They were $18k and $19k, respectively. I also provided NADA and Edmunds trade in value printouts. The averages subtracted from $18,500 were $8300. She said maybe like $1000 or $1500. Should I at this point hire a francy car appraiser and go that route, or am I throwing money in the wind. I was thinking of filing a suit, hiring a fancy auto appraiser and going that route.

The PI claim is still going through the chain of command.

I would ask the adjuster, "just what kind of proof do you need EXACTLY, and I'll get it for you!"

Right if there is a settlement in question, this is the most fitting thing to do. If it is proof they need, it is what they get.

I wonder why they have to deny something legitimate when they already know there are ways to go about it.

Okay, sent out the packet yesterday as stated before. The final paragraph indicated my intentions of a small claims suit as well as the name of my expert witness.

I have an adjuster to come by my work to evaluate my cars repairs. What is this? Any advice on what to do? Anyway, how can a person in the parking lot of my office check a frame for stability, and the suspension that was torn off?

Let the adjuster come and inspect. These days, all carriers have the support of the latest technology towards determining the cause or the extent of the actual damage. Once he's done, you may always seek an explanation from him.

Inspector came and documented the repair and the condition of my auto. I will be waiting for the adjusters response.

I was talking to an old college friend who is a PI lawyer. He found it very odd that the 3rd party offered the policy limits without looking at income verification or doctors releases. He suspects a liability umbrella is being protected. Thoughts??

This could be an attempt to settle things quickly. But, I don't think it could be a real problem under circumstances when a lawsuit is filed. If the compensation awarded is more than the limits, then it's bound to pull the umbrella in.

My UIM policy must first accept the offer. If I settle with the 3rd party and then go after my UIM, will the opportunity to go after the umbrella be over? I asked the 3rd party adjuster she said no umbrella that she knows of.

Your UIM carrier won't allow you to accept the limit if there in an Umbrella, they will do a thorough asset check before they allow you to accept it.
