I'd look for witnesses. Does the police report point you to be at-fault? _________________ Register Now to have your Insurance queries solved. |

Lemme clarify-
I guess they'd look for neutral witnesses if you had been a co-passenger with a friend or a relative. (Or is it all the same?)
Does the police report suggest the driver of your car to be at-fault? _________________ Register Now to have your Insurance queries solved. |

| As a passanger, he is a witness. The author has not really clarified what his needs are. Was he injured in the accident, was the vehicle he was traveling in a souce of transporation he uses on a regular basis where there would be a loss of use claim? |

at least in NY, you sue the driver. He or she is responsible for your accident. When the case is settled, if they find that another party is responsible for the accident, their insurance company will subrogate (recover) for the money. Of course, this will have a huge impact on the relationship between you and the driver. But, if you are legitimately hurt, you may have to. Contact an attorney. _________________ Register Now to have your Insurance queries solved. |
