I was in a car acident where I was a passenger and we had come to a complete stop on a busy intersection in Atl. The teenager did not see that our lane had stopped and rear-ended us fousing us to rear end someone else. What are my options?

I'd look for witnesses. Does the police report point you to be at-fault?

Lemme clarify-

I guess they'd look for neutral witnesses if you had been a co-passenger with a friend or a relative. (Or is it all the same?) Smile

Does the police report suggest the driver of your car to be at-fault? Smile

As a passanger, he is a witness. The author has not really clarified what his needs are. Was he injured in the accident, was the vehicle he was traveling in a souce of transporation he uses on a regular basis where there would be a loss of use claim?

at least in NY, you sue the driver. He or she is responsible for your accident. When the case is settled, if they find that another party is responsible for the accident, their insurance company will subrogate (recover) for the money. Of course, this will have a huge impact on the relationship between you and the driver. But, if you are legitimately hurt, you may have to. Contact an attorney.

Even in NY you cannot hold a not at fault party liable for your injuries... if indeed we are talking about injuries.
