It's all up to the other company or their insurance company as to what action they take. Can they sue? Certainly. How they collect on a judgement is up to what the state allows. Some don't allow much. Others allow wages to be garnish leaving you with slightly more then minimum wage.
Most insurance companies will allow you to set up a payment plan before they turn it over to a collection company or file suit. If this is offered, I'd highly recommend that you take this option. They might even accept a one time lump sum payment (much less then what is owed but all at one time). |
