| i was hit by a police in roanoke county , a county police he claimed soverin ammunuity, i'm sueing my insurance, can i sue for more than what i was covered for.? also the first lawyer kepted my case 3 and a half years and said you need to get another attorny , i thought this would be a easy case. can i sue him?the law suit is still open , i'm disabled for life. |

I chuckled at Trench's response. So true.
You might be filing a Uninsured Motorist Bodily Injury claim as the other party would be liable... you just cannot collect from them. If you filed suit against your carrier then I'm betting it was only done to protect the Statute of Limitations. If you are indeed suing someone then I'm guessing you have another attorney already. If this is the case, why not ask these question of the person whom you're going to be paying 33% of the settlement to?
While government bodies can claim SU, I've not see this hold up in many cases. If they have ever paid out on a liability claim then they most likely have lost this immunity.
You can sue anyone you want... weather or not you have any type of case is another matter. It does not sound like you have much of one against your former attorney as it does not sound like you suffered any damages as a result of his representation. |
