I was rear ended but have no insurance

I was waiting for a pedestrian to cross the street so I could turn right and this lady rear ended me. She was really nice and we talked to her insurance and she admitted she as at fault numerous times. I told her I didnt have insurance and her insurance company suggested we dont call the police, so I dont get a ticket along with a car accident. My trunk on my car is dented and a tail light is broken and thats about it. She gave me all her insurance and contact info and I gave her my contact info. But what am I supposed to do now? I really cant afford a no insurance ticket right now. Ive had a headache since the accident but dont want to go to the doc cause I am scared Ill get in trouble for no insurance.

And I did have insurance. It just expired about a month ago and I didnt know that. The insurance wasnt in my name but I was on it.

You just need to contact her carrier and file a claim. It shouldn't matter if you were uninsured (in this instance). You need to let them know that you have a claim for your vehicle damage and for your injury.

And.....you need to get insurance (NOW)

Yeah..if you're not at-fault then why are you scared to file a claim? Go ahead with your claim and also make sure that you get the right treatment for your injuries.

Let's see...you were on the insurance that expired ? So that translates to ? "the insurance was in someone else's name"? But it's your car ?

Sure seems like you've got a lot more variables than the normal situation we encounter every day. You are entitled to get reimbursement, so why wouldn't you ask for it ?

if you were not at fault then whether or not you have insurance doesn't affect the at-fault party's liability. It's their fault, they (or thier insurer) have to pay. Your lack of cover could cause some logistical issues if the at-fault driver is underinsured, but barring that you should be ok.

As mentioned earlier though, you REALLY need to get some insurance in place.

A few states have 'no pay no play' statues..however, the ones I've read only disallow the uninsured 'victim' any non-economic losses (ie BI pain and suffering) but I've never read one that disallowed vehicle repairs...file the claim already.. :wink:

I'm probably wrong saying this, but..if I am, please correct me. If someone has NO Insurance and gets into a wreck, isn't the accident AUTOMATICALLY their fault for NOT having Insurance? I know you can get some hefty fibes for not having any in most states (I live in PA).

No not at all the fact that a person is insured or uninsured has nothing to do with the determination of liablility (who was at fault)

pretty much..non-economic losses are losses that you aren't actually out any money..

No medical bills would NOT be non-economic losses, they would be economic losses therefore paid.

Well, in my state, I'd could my license and any plates that are in my name, be charged a $200 fine (could be more now, been a long time since I worked in subro)..have to carrie an SR22 for many years, and of course be subject to whatever judgement the innocent party or their carrier got against me for the damage I caused.
