one claim - two checks issued!

My sister was hit a few months back and there was some damage done to her car. The person at fault had insurance that paid for the damage, but a few weeks later she received a second check. She cashed the check. They have now contacted her and are wanting her to pay the money back. My question is if she does not pay this money back, What can they do?

They could turn it over a collection company and it's possible they can file suit. Its tough to convince someone 1) that you did not know you were getting paid twice for the same thing and 2) that you are still entitled to the money once you know it's a double payment.

Lilah, come on your sister knew dag-gum good and well that she didn't have this money coming! And shame on her for keeping it, and on top of that, cashing it, and now not wanting to give it back!

If she doesn't pay it back, (btw, were they both from the the other guys carrier? or one from them and one from her carrier?) They will likely file suit...

Just pay it back for pete's sake! it was NEVER hers!

They can file suit....of course. Your sister knew exactly that she was not entitled to it as it was a double payment......it is hard denying that. She must pay back.
