The car insurance is responsible for my medical bill wont pay me. How do I take them to small claim court?

What do you 'mean' they won't pay you? If it's not your carrier, and the 'at fault' party..they won't pay anything until you settle your BI claim...at that time they will pay all the (reasonable) bills...you have no recourse for that..going to court won't help that situation at all.

It is the at-fault party and his carrier who pays for all the damages. However, you need to settle your bodily injury claims before you take them to small claim court.
