What can i do to speed up the process? Is some one at fault?

I was hit in a parking lot and all the police reports and insurance claims were done. The other driver was at complete fault. i gave my statement to the insurance company and the other driver cannot be contacted because of what ever reasons. It has not been to long maybe almost 2 weeks. What can i do to speed up the process? Is some one at fault? Must i sue to get results? HELLLPPPPPPP

You say there was a police report right? Ask the adjuster if their insured continues to be uncooperative, if they can make their coverage/liability decision based on the police report...They have likely already sent their insured a reservations of rights letter. That typcially rattles about 50% of the non-coop insured out of their shell...Ask the adjuster 'what' they need from their insured, (if they have the report already), is there a coverage issue? Is the policy good? See if the only thing they need is a statement of the facts of loss to determine their liability stance, if that's all they need, then the police report will do...

No, you won't have to sue, unless it turns out that the policy is no good, then you still shouldnt have to...Do you have collision coverage? If so you can always file it with your carrier (it would be a non-chargeable accident if you're not at fault), your carrier fixes your car, (yes you may be out your deductible for awhile) then your carrier will pursue the other guy and his carrier for the money they spent and your deductible.

You can also go by the guys house I guess, and stand right there while he calls his rep...if the rep isn't in or you get a voice mail, hit 'zero' that should route you to someone else...tell them what you need.

It seems that the other party is not cooperating here. Keep a record of all the proceedings till now. You can call the claim adjuster and let them know that you want an answer. if you still get no response you can call the supervisor or the state's insurance department. Read the provisions in your policy that specify the ways to handle a claim.
