| Our car was vandalized at night in a Georgia dept. store parking lot while we were shopping there during Xmas. It appears that gang tags were scratched on the front bumper & the store's shopping cart was used to scratch up the back bumper. The police did not want to come on private property & do a report but we insisted because a crime had been committed. Amica paid for the claim of $2000 after we paid our comprehensive deductible & we had our car repaired. Now, based on the police report that they state they never saw until today, Amica saids that it would like for us to pay 2 separate deductibles for the damages because the Officer who never got out of his car while writing the report only listed the back bumper damages on it & suggested that it could have been done by the wind not human beings. Amica states that the other damage could have been there previously. We told them that this was not true & that own their appraiser who wrote that it was maliciously damaged would have stated this looked like older damage in their report before the claim was approved. We have been with them for more than 8 years & never filed a claim. Please advise. Thanks. |

You seem to be describing two different occurances with the damage. The shopping cart may not be related to the vandalism. How do you know it was done at the same time by the same persons? I doubt the carrier would base this on the police report, as it has been my experiance police officers have very little knowledge of physical damage descriptions. So the insurance company has stated after the fact and post repair that was paid for, that they want you to pay another deductible? If that is the case, I would tell them to pound sand, and find another company.

First off you don't actually pay a deductible to the carrier...they just 'short' the draft they issue by the amount of your deductible. If you've already repaired your vehicle, then you've already paid that deduct to your repairer...If your carrier is now eight months later asking your for a second deduct. I'm with Trench...ditch 'em..this is stupid, and unheard of.

| If you do not have any proof which could point at the fact that the damages were not from any previous collision, there is nothing much to do. If they believe that the damage was from any previous separate accident, then they would charge you 2 deductibles under your collision coverage. |

This sounds like some file reviewer or supervisor just got a chance to reivew this file (audit). Amica is one of the best companies that I ever did work for (1st party claims). Just tell them what happened and it should go away. I wouldn't dump them, but thats up to you. _________________ Can I say I’m working if I stare blankly at my computer all day? |
