I've never heard of a carrier denying a claim for this reason and it be honest, I doubt one would. It's not relevant to the loss.

If your carrier denied the claim then you can sue for bad Faith. If the other carrier denied liability you would probably need to file suit against the owner and/or driver. Very few states allow you to file against the carrier on a 3rd party claim as they did not cause your loss.

In either/any case, I'd probably need to use an attorney. Really depends.
