I was rear ended. My vehicle had a damge of $400. i had personal injury medical cost of $697. The other party inurance paid for repair of my vechle but refused to pay medical cost. Can I sue both insured and insurance in a small claim court for $697 plus pain and suffering?

I guess my first question is why they did not pay for your medical bills. As far as we know, you are in a PIP state and they are not required to pay.
You probably cannot sue the insurance company as they did not cause your injury. Only a few states would allow this. You would file against the driver and/or owner of the other vehicle.
