So my car was stolen about 4 months ago and the insurance company til this day is still "investigating". I bought the car about 2 weeks prior from a private owner and I put full coverage on my car and paid two months in advance. May I input that I did not live in the best neighborhood as our apartment building always got broken into and my husbands car was also broken into about a month.Because of the escalating problems I moved a month after the incident and now live in a very secure building. Well anyway I cooperated with the insurance company in giving all necessary info and so did all the people I was with the night before and the day I purchased the car. After about two months into the investigation the field investigator informed my GRANDFATHER(not even me) about some information they had found out about the car. Apparently the car had been sold at an auction a while back completely totaled. The car was fixed and resold to me. Now I had NO clue to any of this as the title of the car was CLEAR and whom ever did the body work did a really good job because I did not notice anything nor did my friends and family members.

Well now I am stuck because I have already filed a complaint to the DOI because I don't understand why I have to pay for something another person did. I was completely unaware of the situation. I mean if the car was salvaged I wouldn't have even looked at it. Also the investigator went to my husbands job and harassed the staff asking all sorts of questions regarding our lives and about our vehicles. The DOI replied back to me and said that they are currently investigating and no info can be disclose. So now what do I do?
I'm out $5200 and with no transportation with a child to take care of.

Not knowing any mre than you have said; it sounds like your claim has waived soem red flags for one resaon or other and has been sent to SIU which is the insurance companie's internal police department and they are investigating if this vehicle was actually stolen or someone caused it disappear. Ins this economy; a lot of people who owe money on their cars are using all kinds of tricks to get their cars totalled or stolen so they can pay off their loans. As long as you're being honest with them you have nothing to worry about- if they can prove you did something illegal however they can void your claim as intentinal acts are not covered on your policy, not to mention press charges against you. Also never buy a used car without a complete maintenance history and car fax report and have a trusted mechanic and body person look it over first.

I think you can understand that there are a _ton_ of red flags involved in your claim. With that said, your claim is going to be put under a microscope. It _is_ going to take awhile. It unfortunate but I also think 4 months is about the max that any claim like this should take. If you filed your complain with the DOI awhile ago, I'd renew your complaint and have then see what additional info the carrier is getting or expecting. Just keep the pressure on.

What I _would_ expect to have happened (and maybe it has) is that your carrier would be asking for an EUO (Examination Under Oath). If they have not, then I'd say that they are dragging their feet.

You can also keep calling your carrier (a couple of times a week) and asking them what other info they need to move forward. They probably won't tell you but they will get tired of your calls and realize that it's easier to deal with the claim then to take your calls every few days.

So is your complaint that they are closely investigating the loss (which they should), or that your vehicle isn't worth near what you paid for it ?

Well now I am stuck because I have already filed a complaint to the DOI because I don't understand why I have to pay for something another person did.

I understand that, and sympathize, but your carrier didn't do it either, and they should'nt be stuck either...

I was completely unaware of the situation. I mean if the car was salvaged I wouldn't have even looked at it

Clearly the title history showed this, otherwise your carrier couldn't have found this out...I think you fight is with the person that sold it as having a clean title.

Also the investigator went to my husbands job and harassed the staff asking all sorts of questions regarding our lives and about our vehicles

Define "harassed"..they cannot harass anyone, they can ask questions, if 'true' harassment occured, I'd file an additional DOI complaint.

The DOI replied back to me and said that they are currently investigating and no info can be disclose. So now what do I do?

Believe me, the carrier will HAVE to respond within a predetermined time period to any and all DOI complaints...Ask your DOI what the time line is? When is the response from your carrier due back to them.

I'm out $5200 and with no transportation with a child to take care of.

Where is this 5200 figure coming from?
