if one is injured in a bicycle and the other driver at fault

bicyclist injured when the car speeding hit him from behind. Driver at fault's insurance offered settlement but insufficient coverage. Can the UM under the victim's auto insurance apply?

No, but if you have UIM (UNDER Insured Motorist), it would, but you MUST get your carriers authorization to accept policy limits FIRST.

Have to be sure the UM is UMBI not UMPD. On the other hand, if the victim has an auto policy with medical payments, that money should readily be available.

or any states other than CA ( :wink: :wink: ) UIM, is a TOTALLY separate coverage from UM...

Part C - Uninsured/Underinsured Motorists of the Texas Peronsal Auto Policy would apply to uninsured or underinsured and would apply to a bicyclist when injured by an uninsured or underinsured motorists.
