Got rearended while backing to avoid semi

I was at a stoplight semi was turning into lane next to me(turning right, i was going straight) I looked behind to make sure no one was coming and I saw a car coming but they had plenty of time to see my reverse lights and slow down/stop also I only backed up a very miniscule amount then as i turned around to put my truck back into drive I felt a bump. The other couple insisted on reporting it. When the cop arrived their story was totally different than mine they said they were sitting behind me and i backed into them! Cop wrote no ticket but did right an incident report, which unfortunately said I backed up but im not sure if she put if they hit me or i hit them, anyway got a call today from her insurance company asking for a statement.....her deductable is 500 and the estimated damage made by cop was 500 Confused

I would like advice on how this could turn out...

First, one post would be better then three. Second, you kind of skimmed over 1/2 the story. You were stopped in the road and started to back up? Why? It's not something that is normally done on a busy street.

If you have insurance you need to report the accident to them so that they can address the matter.

Its up to you if you want to give the other carrier a statement. You don't need to. They want to know if you backed up into the other person.

Most likely the other carrier will either understand its going to be a he said/she said situation and drop the matter or they will pursue it. Your carrier will probably see it the same way and provide you a defense. They will probably deny liability.

Again, what is going against you is this backing up thing. It does not help your situation.

What the cop says the damage(s) are have ZERO bearing on the situation.

As T said get this turned into your carrier ASAP...trust me...these people could have injuries pop up etc..you don't want to mess with that..Also if you want to pay the claim out of pocket just tell your carrier this, most will oblige as long as you don't drag your feet. Your carrier will investigate the loss, and damages.

One of the things that's going to hurt you (badly) is that the impact occured while your vehicle was still in reverse...

Most likely you will be deemed negligent (at fault) and therefore liable for any and all damage(s) caused by this accident...
