First of all I'm so very very sorry...whatever your affliation with this baby is...
Secondly, there is no average payout...A lot would depend on the circumstances of the accident, and the negligence decision. That being said, "most" carriers would jump in and offer policy limits, even if their insured way considered only 1% at fault.
Personally, I would demand policy limits...(BI) you should be able to handle this without giving up a third to an attorney. If there is 'gross' negligence and the driver has a lot of money...well, then I may reconsider.
