I have been in an accident that was not my fault. the insurance company allstate, has authorzied a check in the amount their repair shop estimated for and they approved a car rental. Can i just cash the check and repair the car myself?

Sure, if you haven't already signed a repair authorization with the shop...If you have better call them and let them know you don't want to repair it. Also better let your adjuster know so they will pay you direct rather than including the shop on the draft....furthermore, you likely will not be entitled to a rental, or if so they will watch it closely, (as they should) and authorized if for only the amount of days it would take a shop to make the repairs.

Also, you don't HAVE to fix your car. They still owe you the amount of damage..so if you just want the money say so.

I'd wait for your reply as to whether they've made the check to you and the shop together.

It's not the same if the check is made both to you and the shop. Still, you'd need to call the adjuster and ask for his views.
