At my job where I worked for 9 + 1/2 years there was an employee who was a bully. After trying to flee her tyrany for many years I was granted reprieve. She then was allowed to follow me to my new shift. I suffered greaty depression and anxiety at the thought of her outburst. I began having panic attacks due to her aggressive loud nature. I complained to the EEOC with no results. She was interfering with my work performance. I left during an altercation due to a panic attack. I was fired basically for having a panic attack. Is this not claimable under my long term disabililty insurance?

I'm sorry and this is going to sound harsh...but Wallerkevin...you worked there for OVER nine years, with this woman (you're a guy right?) she was not your supervisor JUST another employee, therefore had ZERO power over you......I'm going to tell you what I'd tell my son, and your mama should've told you SUCK IT UP! Honey, you really do need to work on a few things...

You say that .

which I sincerely doubt is the reason your employer would give for you being let go. What would they say was the reason you were fired? I ask because you also say,

and

. I left during an altercation due to a panic attack

So I'm guessing your employer would say, "kevin's work performance was bad, and he walked off the job"...Did you tell your boss your were gonig home sick?

My guess is there is no way you'll get short or long term disability after being fired...and may have some trouble getting unemployment, that will depend on your state.

couple other questions: Had you ever seen a doctor for this depression, anxiety and panic attacks? If so how long ago? and for how long were you treated? Have you applied for unemployment?

Again, don't want you to freak out thinking I'm a bully, I'm as far from that as you can get...But you can't go thru life ALLOWING other people to cause you to lose your job. Remember you can ONLY control how YOU respond to situations....

While Lori is correct that this is probably not a valid claim under a disability policy, and employment attorney might just have a field day with a hostile work environment lawsuit on your behalf.

If you have documentation of complaints to management about the hostile environment this other employee created, it could be worth some money from an employer with "deep pockets" as the attorney might say.

Women have won suits based on male coworkers' pinup girl/centerfold posters in their personal lockers. So the events you describe are even more blatant.

So forget the insurance company and try the employment attorney.

It's not claimable. If this bully was replaced with a nice person, you would be able to do your job. As Max said, you may have cause for legal action, but you aren't disabled.
